Premises Liability Accident: Six Figure Recovery

Our client had mobility issues and was moving into an apartment on the second floor with the help of her caregiver.  The carpet on the staircase had shifted, bunched up, and was no longer flat surface to walk on.  Our clients foot slipped on the staircase, she began to fall, she attempted to catch herself with the railing and suffered a shoulder injury. The apartment owner blamed our client for the fall and attempted to make low-ball offers, even stating that their small nominal offer was their “top offer.” Our firm hired an investigator to take statements of the caregiver and investigate whether the Apartment had prior notice of this issue.  Evidence was produced of prior notice, through witnesses and maintenance crew for the apartment, and the Apartment increased their offer by six figures.
